Bank Guarantees cannot be equated with Customs Duty Payment.

The Honble Apex Court in a far reaching judgement in the case of Pantanjali foods has held that furnishing a Bank guarantee is not equivalent to Customs Duty payment. In a case where the Revenue encashed the BG offered has been ordered to be refunded back.
