BIS Compliance Dispute remanded

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Chennai Bench, allowed the appeal by way of remand and directed the Commissioner to undertake a fresh adjudication. 

The Tribunal held that the impugned order, which confiscated imported sanitary napkins and panty liners for alleged violation of the Medical Textiles (Quality Control) Order, 2024 and the Bureau of Indian Standards (BIS) requirements, was a non-speaking order that failed to consider the importer's principal legal submissions.
