CESTAT Excludes Transformer Type Test Charges from Excise Valuation

The Mumbai Bench of CESTAT set aside the excise demand raised on charges collected towards type testing of transformers. 

The Tribunal held that type testing is an optional, post-manufacturing activity carried out at the request of specific customers for separate consideration and, therefore, cannot be included in the transaction value under Section 4 of the Central Excise Act.
