CESTAT quashes Customs demand on CKD imports

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Kolkata, allowed the appeal of the importer and quashed the demand of differential customs duty, interest, penalty and redemption fine.
The Tribunal held that mere availment of a customs exemption notification does not amount to suppression of facts warranting invocation of the extended limitation period.
It further ruled that where self-assessed Bills of Entry have attained finality, the Department cannot reopen the assessment through a show cause notice without first challenging the assessment order in appeal.
