CESTAT upholds Service Tax on Franchise Royalty

The CESTAT, New Delhi, upheld the service tax demand on royalty received by a training institute from its franchisees, holding that the demand was restricted only to amounts actually received by the assessee. 

The Tribunal rejected the contention that certain franchise fees remained unrealized, finding no supporting evidence and affirming the appellate order confirming the demand.
