Delhi HC says FTWZ Warehousing Does Not Create a Re-import Exemption

Baker Hughes and connected appellants proposed moving concessionally imported equipment into an FTWZ after completion of one domestic petroleum contract and bringing the same equipment back for a new contract under a fresh Essentiality Certificate. The Delhi High Court held that this was merely an intervening warehousing arrangement between two domestic transactions and could not convert the subsequent clearance into a re-import eligible for the Notification No. 45/2017 exemption.
