Ex Parte Tax Demand

The Karnataka High Court has quashed an ex parte service tax adjudication order passed without adequate opportunity of hearing and remanded the matter for fresh consideration. 

The Court held that where a taxpayer alleges lack of notice and seeks to raise substantive statutory defences, the adjudicating authority must reconsider the matter after granting a reasonable opportunity of being heard.
