HC restores GST Hearing

The Madras High Court set aside an ex parte assessment order passed under Section 74 of the CGST Act and remanded the matter for fresh adjudication. 

The Court held that, considering the nature of the dispute and the explanation offered for non-participation in the proceedings, the assessee deserved one more opportunity, subject to payment of 25% of the disputed tax amount.
