ITAT quashes Search for non compliance

The ITAT held that after the Finance Act, 2021, search-related assessments for the specified preceding years must necessarily follow the reassessment mechanism prescribed under Sections 148 and 148B, including obtaining the mandatory statutory approval. 

Since the Assessing Officer bypassed this procedure, the assessments were declared without jurisdiction and liable to be set aside.
