Jurisdictional Assessing officers Notices quashed
By J the App
Executive Summary
The Bombay High Court quashed a large batch of reassessment notices issued under Section 148 of the Income-tax Act on the ground that they had been issued by Jurisdictional Assessing Officers (JAOs) instead of Faceless Assessing Officers (FAOs) as mandated under the scheme framed pursuant to Section 151A.
Following its earlier decision in Hexaware Technologies Ltd., the Court held that such notices were invalid in law and consequently set aside all reassessment proceedings, including consequential orders, demand notices and penalty notices.
