Karnataka HC Permits Amendment to Claim Refund and Compensation in Specific Performance Suit

The Karnataka High Court, by its judgment dated 8 July 2026, allowed an amendment application filed during the pendency of a commercial appeal to incorporate claims for refund of the security deposit and compensation in a suit for specific performance. 

The Court held that the Memorandum of Understanding (MOU) was not specifically enforceable since the essential terms of the proposed Joint Development Agreement (JDA) had never been finalised between the parties.
