Mechanical Attachment Quashed

The Gauhati High Court has set aside a provisional attachment of a taxpayer's bank account under Section 83 of the CGST Act, holding that the power cannot be exercised mechanically. 

The Court reaffirmed that the mandatory requirement of forming an independent opinion before ordering provisional attachment is a jurisdictional precondition, and failure to do so renders the attachment legally unsustainable.
