NCLAT rejects Premature RP appeal

The National Company Law Appellate Tribunal (NCLAT), Chennai Bench, by its order dated 15 June 2026, dismissed an appeal filed by a prospective resolution applicant as premature. 

The Tribunal held that where the resolution plan has merely been remitted to the CoC for reconsideration and no adjudication on merits has yet taken place, no enforceable cause of action arises for invoking the appellate jurisdiction under Section 61 of the Insolvency and Bankruptcy Code, 2016.
