No retrospective cancellation

The Delhi High Court has reaffirmed that retrospective GST cancellation cannot come as a surprise. If the show cause notice does not specifically propose cancellation with retrospective effect, the Department cannot impose it through the final order. Procedural fairness must precede adverse tax action.
